SAG-AFTRA's strike against major video game companies, including Activision and Electronic Arts, highlights crucial concerns about AI usage and fair compensation. This article explores the union's position, proposed solutions, and the ongoing negotiations.
SAG-AFTRA's Video Game Strike: AI Concerns and Fair Compensation
Key Issues and the Strike Announcement
On July 26th, SAG-AFTRA initiated a strike against prominent video game companies after prolonged negotiations failed to yield a satisfactory agreement. The strike targets companies like Activision, Electronic Arts, and others, impacting a significant portion of the industry. The central conflict revolves around the responsible use of artificial intelligence (AI) in video game production. While not inherently opposed to AI, SAG-AFTRA expresses deep concern about its potential to displace human performers, create unauthorized digital likenesses, and undermine the careers of aspiring actors. Ethical considerations regarding AI-generated content that may not reflect an actor's values further complicate the issue.
Addressing the Challenges: New Agreements and Temporary Solutions
In response to industry challenges, SAG-AFTRA has developed several agreements to provide temporary solutions and address AI concerns. The Tiered-Budget Independent Interactive Media Agreement (I-IMA) offers a flexible framework for smaller-budget projects ($250,000 to $30 million), incorporating AI protections previously rejected by the video game industry bargaining group. This reflects a proactive approach to mitigating AI risks for independent developers.
A key development was a January agreement with AI voice company Replica Studios, enabling union actors to license their voice replicas under controlled conditions, retaining the right to opt out of perpetual use.
The Interim Interactive Media Agreement and the Interim Interactive Localization Agreement offer additional temporary solutions covering crucial aspects such as:
- Right of Rescission and Producer Default
- Compensation and Rate Maximums
- AI/Digital Modeling Protections
- Rest and Meal Periods
- Late Payment Provisions
- Health and Retirement Benefits
- Casting and Auditions (Self-Tape)
- Overnight Location Consecutive Employment
- Set Medics
These interim agreements specifically exclude expansion packs and downloadable content, focusing on the initial game release. Projects approved under these agreements are exempt from the strike.
The Path to the Strike: Negotiations and Union Resolve
Negotiations began in October 2022, culminating in a near-unanimous (98.32%) vote by SAG-AFTRA members to authorize a strike in September 2023. Despite progress on various fronts, the lack of concrete and enforceable AI protections remains the central sticking point.
SAG-AFTRA President Fran Drescher stated the union's unwavering stance: "We’re not going to consent to a contract that allows companies to abuse A.I. to the detriment of our members."
Union leadership emphasizes the industry's substantial profits and the vital role of SAG-AFTRA members in bringing video game characters to life. The union's commitment to securing fair AI practices and preventing exploitation remains resolute. The strike underscores the importance of equitable treatment and protection for performers in the evolving landscape of video game development.
